FCC CHAIRMAN JULIUS GENACHOWSKI ANNOUNCES NEW BROADBAND ACCELERATION INITIATIVE ACTIONS; CLARIFIES RULES TO SPEED WIRELESS INFRASTRUCTURE DEPLOYMENT; MOVES TO EXPEDITE TEMPORARY CELL TOWERS

Actions would provide more certainty to providers and spur private investment and deployment of critical high-speed Internet equipment

(Washington, D.C.) - FCC Chairman Julius Genachowski today announced new actions as part of the Broadband Acceleration Initiative, a comprehensive effort to remove barriers to broadband build-out, including streamlining the deployment of mobile broadband infrastructure, such as towers, distributed antenna systems (DAS) and small cells.

The Commission defined and clarified a technical provision in the Middle Class Tax Relief and Job Creation Act of 2012 regarding local review of requests to modify an existing wireless tower or base station. This provision will accelerate deployment and delivery of high-speed mobile broadband to communities across the nation. This action will create greater certainty and predictability for providers that today invest more than $25 billion per year in mobile infrastructure, one of the largest U.S. sectors for private investment.

The Commission today also launched a proceeding to expedite placement of temporary cell towers - cells on wheels (COWs) and cells on light trucks (COLTs) - that are used to expand capacity during special events, such as the Inauguration or the Super Bowl.

Chairman Genachowski also announced actions in the coming months to further streamline DAS and small cell deployment; examine whether current application of the tower siting shot clock offers sufficient clarity to industry and municipalities; and begin developing model facility siting rules for localities. Each of these actions would contribute to faster, more efficient deployment of wireless infrastructure.

Chairman Genachowski said, "Providing more certainty to industry and municipalities, and more flexibility to carriers to meet extraordinary, short-term service needs will accelerate private and public investment to strengthen our nation's communications networks. Just as is the case for our nation's roads and bridges, we must continue to invest in improvements to cell towers and transmission equipment, in order to ensure ubiquitous, high-speed Internet for all Americans. Chandra Levy, a 24-year-old grad student from the University of Southern California, went missing in 2001 after completing a federal internship.

The 2001 slaying of Washington, D.C., intern Chandra Levy is back in court, but behind closed doors: Records show a judge has been holding secret hearings in the case of the man convicted of killing her, according to The Associated Press.

Hearings have been held for the past several weeks, with neither prosecutors nor defense lawyers revealing their purpose, according to court records obtained by AP. The next hearing will be on Feb. 7 in D.C. Superior Court; The AP and several other media organizations are petitioning to open the proceedings.

Ingmar Guandique was?convicted of first-degree murder in November 2010, nine years after Levy's disappearance and death, despite no DNA evidence linking him to the crime, and a lack of witnesses.

Levy's father, Robert Levy, told?KGO-TV in San Francisco?that he has not been told what's been happening in the secret court hearings. He said Guandique was a "convicted rapist and an illegal alien."?

But, he added, "if he's innocent of murder, he shouldn't be in jail for it."?

Police had initially questioned then-California Rep. Gary Condit -- who Levy was romantically tied to -- in their search for suspects, before determining he wasn?t involved. The following year, when Levy's remains were found in a Washington national park, authorities charged Guandique, who was already in prison for attacking female joggers in the same park, reported The AP.

Levy's case stole the attention of the national media. Condit was never charged, but his political aspirations were ruined nonetheless.

Prosecutors had requested a life prison sentence for Guandique, an illegal immigrant from El Savador. Instead, he was given a 60-year sentence, which he?is currently serving.

After he was sentenced, Levy's mom, Susan, asked him if he was the one who killed her daughter, and he shook his head.

"Mr. Guandique, you are lower than a cockroach," she?told him at the time, according to The AP.

The Department of Psychiatry and Behavioral Health is a comprehensive, multidisciplinary system, which includes two emergency rooms, two adult inpatient units, two outpatient clinics (child and adult), a therapeutic school and milieu for adolescents, community outreach services, intensive outpatient treatment programs, specialty clinics, a multi-service substance abuse facility, a behavioral science research unit, and a consultation-liaison psychiatry service. The Fellowship settings are:

Psychiatric Recovery Center (PRC) is an intensive outpatient program offering services designed to meet the needs of individuals with severe and persistent mental illness. A work and recovery model informs the treatment, and supports the goal of engagement in vocational, pre-vocational, or educational activity, either on-site or outside of the program. PRC offers: intake evaluation; acute symptom management and crisis intervention; psychopharmacologic management; individual psychotherapy; group psychotherapy (i.e. respectively informed by CBT, DBT, process approach, and others); family therapy; vocational assessment and rehabilitation, social services and entitlements needs assessment, linkage and case management; medical assessment and treatment; and disposition planning, linkage and follow-up. Patients may receive psychodiagnostic assessment to help clarify diagnosis and level of functioning. This is a multidisciplinary environment ? in which interns work in terms with psychiatric residents, nurses, social workers, case managers, and occupational therapists. The psychologist Director, as well as other psychologists on staff provide supervision. There is one Fellowship position in the PRC.

The Center for Intensive Treatment of Personality Disorders (CITPD) is an intensive outpatient treatment program for adults who are in acute, often suicidal, crisis. The majority of patients have affective illness and/or axis II pathology. Treatment takes the form of various group and individual sessions aimed at helping patients resolve acute crisis and make the transition back into the community. Dialectical Behavior Therapy (DBT) is a treatment focus as well as psychodynamic and process work. CITPD offers: intake evaluation; acute symptom management and crisis intervention; psychopharmacologic management; individual psychotherapy; group psychotherapy; social services and entitlements needs assessment, linkage and case management; medical assessment and treatment; and disposition planning, linkage and follow-up. Patients may receive psychodiagnostic assessment to assist differential diagnosis, treatment planning and disposition planning or linkage. The psychologist Director, as well as other psychologists and professionals on staff, provide supervision. There is one Fellowship position in CITPD.

The Addiction Institute of New York (AI) is a comprehensive substance abuse treatment center ? which includes detoxification, intensive inpatient and outpatient rehabilitation, outpatient treatment programs, residential treatment, methadone, buprenorphine and other pharmacologic treatment, and a consultation service for medical/surgical inpatient units. It includes specialty outpatient clinics ? such as: ?Crystal Clear? relapse prevention program for stimulant-using men who have sex with men; young adult program for individuals with various types of substance use; DBT-informed groups for dually diagnosed individuals with Axis II disorders, etc.). It also includes consultations with the medical/surgical services. The Psychologist Clinical Director, Assistant Director, Outpatient Treatment Programs, as well as other psychologists and professionals on staff, provide supervision.? There are two Fellowship positions in AI.

The Adult Outpatient Psychiatry Clinic (Adult OPC) serves individuals with a broad range of psychiatric diagnoses, socioeconomic backgrounds, and ethnic, cultural and sexual identities, and life situations. The Adult OPC provides: intake assessment; individual psychotherapy (psychodynamic, cognitive-behavioral, dialectical behavior, and supportive therapy); group psychotherapy; crisis intervention; and family therapy (i.e. delivered in front of one-way mirror, observed, with live supervision), all within multidisciplinary teams. The Fellow will have an opportunity to focus additionally on the psychological treatment of individuals with significant medical illnesses. Staff and adjunct, psychologists provide the majority of supervision, in addition to regular meetings with the psychiatrist Director. There is one Fellowship position in the Adult OPC.

The Trauma-Focused Programs (TFP) serve the mental health needs of survivors of trauma or abuse, many of whom are also in recovery from substance use. The Programs provide empirically supported individual and group psychotherapy, pharmacotherapy and case management. Clients may present with a range of mental health issues, including posttraumatic stress disorder, other significant anxiety or mood disorders, or dissociative disorders. The Women?s Health Project (WHP) and The Men?s Center For Healing and Recovery (MCHR) are separate to maintain a sense of safety and gender-specific support. Fellows provide individual and group psychotherapy and initial consultations. Training includes a weekly didactic seminar in the treatment of trauma and addiction and a weekly psychotherapy case conference in which students and staff present case material. Supervision is provided by psychologists and social workers with expertise in trauma and addictions. Fellows have the opportunity to supervise pre-doctoral candidates on clinical interviewing skills. Researchers discover new mutations driving malignant melanoma

Two new mutations that collectively occur in 71 percent of malignant melanoma tumors have been discovered in what scientists call the "dark matter" of the cancer genome, where cancer-related mutations haven't been previously found.

Reporting their findings in the Jan. 24 issue of Science Express, the researchers from Dana-Farber Cancer Institute and the Broad Institute said the highly "recurrent" mutations ? occurring in the tumors of many people ? may be the most common mutations in melanoma cells found to date.

The researchers said these cancer-associated mutations are the first to be discovered in the vast regions of DNA in cancer cells that do not contain genetic instructions for making proteins. The mutations are located in non-protein-coding DNA that regulates the activity of genes.

This non-coding DNA, much of which was previously dismissed as "junk," accounts for 99 percent of a cell's genome. A large number of oncogenic mutations in cancer have been identified in the past several decades, but all have been found within the actual genetic blueprints for proteins.

"This new finding represents an initial foray into the 'dark matter' of the cancer genome," said Levi Garraway, MD, PhD, of Dana-Farber and the Broad and the article's senior author.

"In addition, this represents the discovery of two of the most prevalent melanoma gene mutations. Considered as a whole, these two TERT promoter mutations are even more common than BRAF mutations in melanoma. Altogether, this discovery could cause us to think more creatively about the possible benefits of targeting TERT in cancer treatment or prevention."

The mutations affect a promoter region ? a stretch of DNA code that regulates the expression of a gene ? adjacent to the TERT gene. TERT contains the recipe for making telomerase reverse transcriptase, an enzyme that can make cells virtually immortal, and is often found overexpressed in cancer cells. A promoter region of DNA controls the rate of a gene's transcription ? the copying of its DNA recipe into a message used by the cell to manufacture a protein.

"We think these mutations in the promoter region are potentially one way the TERT gene can be activated," said Franklin Huang, MD, PhD, co-first author of the report along with Harvard MD-PhD student Eran Hodis, of Dana-Farber and the Broad Institute.

To investigate the mutation's effect, the researchers hooked the mutant TERT promoter to a gene that makes luciferase ? a light-emitting protein. They observed that the mutant promoter increased the production of luciferase in laboratory cell lines. In the same way, the scientists presume, the mutant promoter in human pigmented skin cells can send the TERT gene into overdrive, potentially contributing to the development of melanoma.

The mutations were discovered when the scientists sifted through data from whole-genome sequencing of malignant melanoma tumors. Unlike "whole-exome" searches that examine only the protein-coding DNA of a cell's genome, whole-genome searches scan all of the DNA, including the non-coding regions.

In analyzing whole-genome data, the investigators discovered the two somatic, or not-inherited, mutations in 17 of 19 (89 percent) of the tumors. Next, they sequenced a larger number of melanoma tumors and found that the two mutations were present in 71 percent of tumors in total.

The researchers said the same mutations are present in cell lines from some other malignancies, and that preliminary evidence showed they might be unusually common in bladder and liver cancers. They also noted that the discovery of these important mutations in DNA previously not linked to cancer-causing alterations highlights the value of whole-genome searches of tumor DNA.

Prepare Ahead for STAAR and EOC Testing Accommodation ...

Parents and teachers prefer to provide for a student?s educational? needs without having to consider that the child may have a disability. ?For many students with both mental and physical impairments, particularly within the elementary grades, referrals for Section 504 eligibility determination may be avoided or delayed if the student is able to receive RtI, health services, or dyslexia services outside of Section 504 or Special Education identification.? With the increased rigor of End of Course exams in high school, districts and parents may suddenly realize that students will face serious roadblocks to graduation and college admission without access to accommodations available only to students identified as Section 504 or Special Education with a documented need written into an Individualized Accommodation Plan or IEP.?? According to the currently posted TEA Accommodations Triangle, http://www.tea.state.tx.us/student.assessment/accommodations/staar-telpas/ , a student must need the accommodations within the classroom, and use them routinely and effectively as well as meet very specific eligibility criteria.

?

Many of the new STAAR Accommodations are available to any students, students within RtI, 504 only, or Special Education, but some, like Spelling Assistance on Reading Assessment short answers and Written Composition, and Calculative Devices are not available to only 504 or Special Education students.? Additionally, an Oral/Signed Administration accommodation is not available to any student, unless that student has also been identified with dyslexia and is in RtI, or is a Section 504 or Special Education student with dyslexia or has evidence of reading difficulties.

?

This suddenly realized fear that a child might need an accommodation to pass, but does not currently meet the eligibility criteria, can cause panic in the hearts of parents of struggling students when they consider the consequences to high school graduation, documentation to support the need for SAT/ACT accommodations, college admissions and access to services for students with disabilities at the college level.? This nagging fear can cause panic in the minds of school administrators when they consider the impact that failing STAAR or EOC scores will have on state and federal accountability measures as well as the educational planning and resources needed to remediate student achievement.? This sudden realization may also result in larger numbers of students being referred for Section 504 or Special Education evaluation a month, two weeks, or even days ahead of STAAR and EOC testing dates. ??The time involved with gathering the data along with documentation insuring accommodations have been routinely and effectively used in the classroom and are usually a logistical impossibility within these last minute time parameters.

?

Fear of anticipated student low performance or failure on STAAR or EOCs should never be the sole cause for initiating a Section 504 or Special Education evaluation to determine need for accommodations.? However, it is possible that a disabled student ?who may have survived their school career without being identified as Section 504 or Special Ed eligible will now need documented accommodations due to the following circumstances: ?teachers freely made accommodations,? the student was able to receive the Dyslexia Bundled Accommodations without being Section 504 in previous years of TAKS testing, the physical or mental disability now limits a major life activity due to increased expectations or limited time parameters, lack of access to effective interventions, or even changes in the student?s health conditions.

?

Below are a few tips for making sure that students who truly need testing accommodations receive them long before STAAR and EOC test dates arrive:

-Establish and communicate district policies to both parents and teachers of all grade levels about referral processes and the types of information needed to warrant suspicion of a disability.

  • Public school staff may access a free Region 13 online workshop entitled: ?Understanding Basic 504 Procedures and Services:? A Campus Training? by registering with Workshop ID:?? FA1224572
  • Contact your regional Education Service Center 504 Specialist to aid with establishing district procedures and parent education regarding Section 504.

-For students within RtI, be sure that RtI teams are collecting progress monitoring data and referring students to 504 or Special Education evaluations when more intensive services and protections are warranted.

-Be sure that English Language Learners are not being overlooked.? Specialized training is needed by assessment personnel to determine if poor achievement is due to the process of English language acquisition, or is also impaired by a mental or physical impairment.? This is especially true if the impairment is dyslexia.? Contact your regional educational specialist in dyslexia if you need to contract with a Bilingual Assessment Specialist.

-Educational need is not required to trigger the need for Section 504 referral.? A child need not have failing grades or previously failing test scores before being evaluated for Section 504.

-Remember that there is no standard set of accommodations for any specific type of disability.? Both classroom and testing accommodation decisions should be based on evidence of student need on a case by case basis, and documented within that student?s Individualized Accommodation Plan or IEP.? The TEA Accommodations Triangle provides specific guidance for how the need and effectiveness for many accommodations can be determined.

-Consult with Assistive Technology Specialists, within district or Education Service Center regional specialists, for tools in how to determine the best low or high-tech device for each student.? Experiment with the student to evaluate the effectiveness of the technology.

-Remember that providing unnecessary accommodations within the classroom and in testing situations can be damaging to a student and their future educational success.

The chairman of a Senate subcommittee charged Tuesday that House Republicans sank embassy security funds in stripping a $1 billion measure sought by the State Department from a hurricane relief bill.

Did an 8th century gamma ray burst irradiate Earth?

Jan. 21, 2013 ? A nearby short duration gamma-ray burst may be the cause of an intense blast of high-energy radiation that hit the Earth in the 8th century, according to new research led by astronomers Valeri Hambaryan and Ralph Neuh?user.

The two scientists, based at the Astrophysics Institute of the University of Jena in Germany, publish their results in the journal Monthly Notices of the Royal Astronomical Society.

In 2012 scientist Fusa Miyake announced the detection of high levels of the isotope Carbon-14 and Beryllium-10 in tree rings formed in 775 CE, suggesting that a burst of radiation struck the Earth in the year 774 or 775. Carbon-14 and Beryllium-10 form when radiation from space collides with nitrogen atoms, which then decay to these heavier forms of carbon and beryllium. The earlier research ruled out the nearby explosion of a massive star (a supernova) as nothing was recorded in observations at the time and no remnant has been found.

Prof. Miyake also considered whether a solar flare could have been responsible, but these are not powerful enough to cause the observed excess of carbon-14. Large flares are likely to be accompanied by ejections of material from the Sun?s corona, leading to vivid displays of the northern and southern lights (aurorae), but again no historical records suggest these took place.

Following this announcement, researchers pointed to an entry in the Anglo-Saxon Chronicle that describes a ?red crucifix? seen after sunset and suggested this might be a supernova. But this dates from 776, too late to account for the carbon-14 data and still does not explain why no remnant has been detected.

Drs. Hambaryan and Neuh?user have another explanation, consistent with both the carbon-14 measurements and the absence of any recorded events in the sky. They suggest that two compact stellar remnants, i.e. black holes, neutron stars or white dwarfs, collided and merged together. When this happens, some energy is released in the form of gamma rays, the most energetic part of the electromagnetic spectrum that includes visible light.

In these mergers, the burst of gamma rays is intense but short, typically lasting less than two seconds. These events are seen in other galaxies many times each year but, in contrast to long duration bursts, without any corresponding visible light. If this is the explanation for the 774 / 775 radiation burst, then the merging stars could not be closer than about 3000 light years, or it would have led to the extinction of some terrestrial life. Based on the carbon-14 measurements, Hambaryan and Neuh?user believe the gamma ray burst originated in a system between 3000 and 12000 light years from the Sun.

If they are right, then this would explain why no records exist of a supernova or auroral display. Other work suggests that some visible light is emitted during short gamma-ray bursts that could be seen in a relatively nearby event. This might only be seen for a few days and be easily missed, but nonetheless it may be worthwhile for historians to look again through contemporary texts.

Astronomers could also look for the merged object, a 1200 year old black hole or neutron star 3000-12000 light years from the Sun but without the characteristic gas and dust of a supernova remnant.

Dr Neuh?user comments: ?If the gamma ray burst had been much closer to the Earth it would have caused significant harm to the biosphere. But even thousands of light years away, a similar event today could cause havoc with the sensitive electronic systems that advanced societies have come to depend on. The challenge now is to establish how rare such Carbon-14 spikes are i.e. how often such radiation bursts hit the Earth. In the last 3000 years, the maximum age of trees alive today, only one such event appears to have taken place."

Satmar Spends Election Day with the Rebbe in N. Israel

The thousands of Satmar Chassidim accompanying the Rebbe Shlita during his visit in Eretz Yisrael are in the north today, Tuesday 11 Shevat 5773, Election Day, visiting kivrei tzaddikim. According to chareidi media reports, this was done intentionally to pull many chassidim out of Yerushalayim on Election Day to prevent confrontations with Gimmel activists, with the latter calling on the Bnei Torah tzibur to vote. Satmar remains ideologically opposed to taking part in the ?Zionist elections? as pashkavilim in Meah Shearim confirm.

The chassidim in the north will begin in Tzfas, visiting the mikve and the tziyun of the Ari HaKodosh followed by the rebbe visiting a number of mosdos that do not accept state funding. They will also travel to Tiveria; and visits will include the tziyun of Rabbi Akiva and Rabbi Meir Bal Haness. They will also be visiting Amuka and Kever Rashbi. The rebbe will hold a tisch at the Rashbi and children will receive a chalaka (upsherin).

Must See HDTV January 21st  27th

We'll take a break from football -- true addicts can give the Pro Bowl and Senior Bowl a look -- for one weekend before the big game, but there are other options. That includes hockey now, of course, but also a few premiering and returning shows. Look below for the highlights this week, followed after the break by our weekly listing of what to look out for in TV, Blu-ray and videogames.

The Following
If you need a few more connections in your next six degrees of Kevin Bacon game, tune in to The Following, which pits Bacon as an FBI agent chasing down serial killer (and leader of other killers) James Purefoy. It's been heavily promoted, but we'll find out tonight if the high profile cast and production add up to a show worth watching -- it didn't work so well for ABC's Last Resort, which is airing its series finale this week.

Spartacus: War of the Damned
The last season of Starz' hit Spartacus: War of the Damned kicks off Friday night, and should bring along all the associated violence we've come to expect from the series. As Marcus Crassus and Julius Caesar join the fight things are only going to get more interesting, if you've somehow missed out on the show till now you can check out a trailer embedded after the break. The special effects have never surpassed the level of most made-for-Syfy movies, but somehow it manages to become more than the sum of its parts.

The Cave
The next adventure game from Double Fine, The Cave hits a slew of platforms this week. Available for download on Steam, PSN, Xbox Live and Wii U eShop, it lets player's pick their own squad of adventures and explore -- what else -- a cave. Somehow that area will include an amusement park, castle and even a ready to launch nuke, but we're most interested to see how it integrates the Wii U GamePad for camera and character switching.
